Gas station shelves put Delta 8 gummies next to Delta 9 gummies, both labeled "hemp." The real differences are how each compound got into the jar and what the law is about to say about it.
We make and sell naturally derived hemp Delta 9 products, our Good Time Gummies and the Compliant Products 10:1 gummies, and we do not sell Delta 8. This is a brand-authored comparison, kept honest because the 2026 law changes reach our products too.
Delta 8 vs Delta 9 THC: The Short Answer
Pick the THC the plant actually made
Delta 9 is the THC hemp makes on its own, capped by law. Hemp holds only traces of Delta 8, so most Delta 8 is made by converting CBD with chemicals, and the FDA has warned about contaminants. Effects are similar, with Delta 8 usually described as milder. Both show up on drug tests. If you want THC from hemp, naturally occurring Delta 9 with a published COA is the more transparent choice, and the only THC we sell.

Delta 8 vs Delta 9 THC Chemistry
One double bond, one carbon over
Both are tetrahydrocannabinol, built from the same atoms, and the "delta" number marks where one double bond sits: the eighth carbon or the ninth. Cleveland Clinic describes them as having "nearly identical chemical structures," and both act on the CB1 receptor.
A 2022 review in the British Journal of Pharmacology found Delta 8 is a partial agonist at CB1 with weaker receptor affinity than Delta 9, which the authors say can explain its reduced potency in clinical studies, though other mechanisms may contribute. A 2024 review in Molecules calls Delta 8 "the positional isomer" of Delta 9, "much more stable" and much easier to make by chemical synthesis.
How Delta 8 and Delta 9 Get Into Hemp Products
Grown in the plant or made in a lab
Hemp makes Delta 9 THC directly, and the law caps it at 0.3 percent by dry weight. Our FAQ on the Compliant Products gummies shows how a legal gummy reaches 10mg: a 5.0 gram gummy at about 0.2 percent THC holds 10mg, and a 2.8 gram gummy holds 5.6mg. The distillate comes from the plant, ten parts CBD to one part THC.
Delta 8 is different. The FDA says it "is not found in significant amounts in the cannabis plant" and is "typically manufactured from hemp-derived cannabidiol (CBD)." The Molecules review calls natural levels "exceedingly low," so extraction "holds little economic viability." Instead, CBD is treated with acid to rearrange it into Delta 8. Analyses of marketed Delta 8 products turned up hydroxylated HHC compounds as by-products, and "other impurities are still unknown."
Delta 8 vs Delta 9 Effects and Potency
Similar effects, usually milder with Delta 8
The pharmacology review found the two behave "very similar" in the body, with Delta 8 less potent in the clinical studies that compared them, many decades old, and calls for more human studies. Less potent is not mild. The FDA says Delta 8 "has psychoactive and intoxicating effects, similar to delta-9 THC."
The first large user survey, published in 2022 in the Journal of Cannabis Research, covered 521 Delta 8 consumers recruited through a Delta 8 manufacturer's social media and a Delta 8 Reddit forum. Most reported a lot or a great deal of relaxation (71 percent) and euphoria (68 percent), most did not experience anxiety (74 percent) or paranoia (83 percent), and 81 percent reported at least moderate trouble concentrating. The authors call it self-report data from a self-selected sample. A 2023 scoping review in Addiction found most Delta 8 research "is largely anecdotal, not peer-reviewed and does not involve human subjects."
Delta 8 THC Safety Concerns
What the FDA found in the reports
The FDA says hemp cannabinoid products are not FDA evaluated and that Epidiolex is the only CBD drug it has approved. Its 2022 alert on THC edibles and children covers any THC gummy, ours included. For Delta 8 it published a dedicated warning, last updated May 2022: 104 adverse event reports between December 1, 2020 and February 28, 2022, 55 percent requiring intervention or hospital admission, 66 percent after food products like gummies, with hallucinations, vomiting, anxiety and loss of consciousness among the events.
Poison control centers logged 2,362 Delta 8 exposure cases between January 1, 2021 and February 28, 2022, 41 percent in patients under 18, with one pediatric death. The FDA's chemistry concern: "Some manufacturers may use potentially unsafe household chemicals" in the conversion, and the product "may have potentially harmful by-products (contaminants)." Delta 9 carries THC's own risks, so our THC products are 21+, labeled by the milligram and third-party tested. Keep all of it away from children and pets.
Delta 8 vs Delta 9 on a Drug Test
Both can fail a THC screen
If you are drug tested, there is no safe side. The standard urine screen catches Delta 9 through its metabolite THC-COOH. Delta 8 is a near twin, and a 2023 study in the Journal of Analytical Toxicology, funded by the National Institute of Justice and the NIH, found all six urine immunoassay kits it tested cross-reacted with Delta 8 THC and its two major metabolites, to varying degrees by kit and cutoff.
Confirmatory lab testing can tell the isomers apart; the initial screen cannot. Our post on passing a drug test while using full spectrum CBD covers trace THC. A 10mg Delta 9 gummy is not trace THC. If your job tests, skip both.
Delta 8 vs Delta 9 Legality in 2026
Two dates, and both sides are affected
Today's federal rule is still the 2018 Farm Bill definition: hemp with no more than 0.3 percent Delta 9 THC by dry weight, the rule both products rely on today. Public Law 119-37, approved November 12, 2025, redefines hemp by "total tetrahydrocannabinols concentration (including tetrahydrocannabinolic acid)" and excludes any final hemp-derived cannabinoid product with "greater than 0.4 milligrams combined total per container" of total THC, a container being the innermost retail package, "such as a jar, bottle, bag, box, packet, can, carton, or cartridge." It also excludes products with "cannabinoids that are not capable of being naturally produced by a Cannabis sativa L. plant" and cannabinoids the plant can make that "were synthesized or manufactured outside the plant."
H.R. 6500, signed September 2, 2026, says that "until December 11, 2026" those changes "shall only apply" to products with cannabinoids the plant cannot naturally produce. So: November 12, 2026 for those, December 11, 2026 for everything else, including the 0.4mg cap that a 10mg or 5.6mg Delta 9 gummy exceeds, ours included. Converted Delta 8 appears to fall under the "manufactured outside the plant" clause, since hemp does make traces of it, which points to the December date; if the FDA's required list of naturally produced cannabinoids leaves Delta 8 off, November applies instead. Either way it loses federal hemp status by December 11. As of early September the FDA had not published those lists or its container guidance, and bills to delay, repeal or regulate sit in committee, so watch the dates. State laws vary, so check your state before you buy.
Who Should Choose Delta 9 or Delta 8
Best For
Choose Delta 9 if
You want THC the plant actually made
- You want a labeled milligram amount backed by a batch COA.
- You'd rather avoid chemical conversion and its unidentified by-products.
- You want CBD alongside the THC, as in our Good Time Gummies or the 10:1 Compliant gummies.
Choose Delta 8 if
You've decided Delta 8 is for you
We don't sell it. If you buy it, read the COA for residual solvents and unidentified peaks, confirm a licensed lab ran it, and check your state's rules. Both compounds face federal changes in late 2026.

Delta 8 Pros and Cons
Pros
- Described as less potent than Delta 9 in the studies that compared them.
- Survey respondents reported less anxiety and paranoia, though self-reported.
- Chemically more stable than Delta 9.
Cons
- Most commercial Delta 8 is made from CBD with chemicals, and the FDA has flagged contaminants.
- Cross-reacted, to varying degrees, with all six urine screening kits in a 2023 study.
- Loses federal hemp status by December 11, 2026, and some states already ban it.
What Is Actually in a Hemp Gummy
Read the label, then read the COA
The label gives the cannabinoid and milligrams per piece and per container. The Certificate of Analysis tells you whether the label is true. For any THC gummy, look for total THC (Delta 9 plus THCA, and Delta 8 if present), the CBD number, and the residual solvent, heavy metal, pesticide and microbial panels. For Delta 8, read the solvent panel closely. No COA for your jar's batch number means no purchase.
Here at Partnered Process, we post a COA for every batch on our Lab Results page, and our Delta 9 products come from hemp grown on Wisconsin and American farms, processed in our USDA Certified Organic, GMP-certified facility in Friendship, Wisconsin. Start low and go slow with any THC product, and talk to your doctor or pharmacist first if you take medication, are pregnant or nursing, or have a health condition.

Delta 8 vs Delta 9 Questions
Frequently Asked Questions
Does Delta 8 Give the Same High as Delta 9?
Similar, but usually weaker. A 2022 pharmacology review found the two act very much alike in the body, with Delta 8 less potent in the clinical studies that compared them, which the authors say can be explained by weaker CB1 receptor binding. The FDA still calls its effects "psychoactive and intoxicating," and retail Delta 8 products vary in strength and purity.
Is Delta 8 or Delta 9 Better for Anxiety?
Neither is an approved treatment for anxiety, and we won't claim otherwise. In a 2022 survey of 521 Delta 8 users, 74 percent said they did not experience anxiety, but the data was self-reported and recruited partly through a Delta 8 manufacturer. Both compounds can also cause anxiety; the FDA lists it among Delta 8 adverse events. Talk to a doctor or pharmacist first.
Will Hemp Derived Delta 9 Get You High?
Yes. Delta 9 THC from hemp is the same molecule as Delta 9 THC from marijuana; "hemp" only means the plant tested at or under 0.3 percent THC by dry weight. A 10mg gummy is a full serving of THC, not a trace amount. Our Good Time Gummies pair 10mg of Delta 9 with 10mg of CBD. Take one serving, then wait.
Does Delta 8 Show Up on a Drug Test?
Yes. A 2023 study found all six commercial urine immunoassay kits it tested cross-reacted with Delta 8 THC and its major metabolites, so Delta 8 can trigger the same positive screen as Delta 9. A lab confirmation can separate the two isomers, but the screening cup does not. If you are tested at work, avoid both.
